Privacy Policy

This promotion is operated and administered by Privatbrauerei ERDINGER Weissbräu, Werner Brombach GmbH, Lange Zeile 1 + 3, 85435 Erding GERMANY (the Promoter). The Promoter has engaged STACI UK of Walker Park, Blackburn BB1 2LG (STACI) to fulfil and distribute the Second Prizes (as defined below) available to be won in this promotion.

  1. The personal data that you provide when you submit an entry to this promotion will be used by the Promoter for the purposes of administering and managing your participation in the promotion, verifying eligibility and selecting the winners in accordance with the terms and conditions relating to the promotion below (Terms and Conditions).
  2. If you win the First Prize (as defined below), the Promoter will:
    • a. make your name and county available, as a winner of this promotion, to people requesting that information in accordance with the Terms and Conditions and as required by the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing. If you do not want your name to be made available, please inform the Promoter using the contact details in paragraph 7 of this Privacy Policy (the Promoter may nevertheless disclose the information to the Advertising Standards Authority if required); and
    • process your data (and that of your guest) to arrange fulfillment and deliver of your prize.
  3. If you win a Second Prize (as defined below), the Promoter will share your personal data with STACI to arrange fulfillment and delivery of your prize. STACI will process your personal data only for the purposes of prize fulfilment and delivery.
  4. The Terms and Conditions are the legal basis on which the Promoter and STACI will process your personal data. If you do not provide your personal data, the Promoter cannot enter you into this promotion, process your entry, inform you if you have won or provide you (or your guest) with the First Prize, and STACI cannot provide you with a Second Prize.
  5. Neither the Promoter or STACI will share your personal data with any third party other than those who are engaged by them to fulfil and deliver the prizes. Your personal data may be sent to countries outside of the UK in order to conduct aspects of the promotion. Where this occurs, the Promoter and STACI will each ensure that any transfer happens in accordance with applicable law.
  6. If you are not successful in winning a prize, the Promoter will delete your personal data promptly after the winners have been selected. If you are successful in winning a prize, the Promoter will delete your personal data (and that of your guest where applicable) promptly after three months have elapsed from the promotion closing date or, if you are the winner of the First Prize, promptly after all elements of the First Prize have been fulfilled. STACI will not keep your personal data for any longer than it needs to, either to comply with the law or to fulfil its obligations to you and other third parties.   7. In accordance with the applicable data protection laws and regulations, the Promoter and STACI each remind you that at any time you may exercise your rights of access, rectification, deletion, limitation of treatment, opposition to treatment, including a right to require your personal data is erased (but note that this will automatically remove your entry from the promotion and mean that you cannot receive or take up a prize), a right to amend your data and the right to ask to port (transfer) your data directly to another organisation by writing to the Promoter at gewinnspiel@erdinger.de or to STACI at CMBC.team@Staciuk.com
  8. If you believe that the Promoter and/or STACI are not treating your personal data in accordance with the law, you have a right to lodge a complaint with the Information Commissioner's Office or other competent authority. You can find more details at their website https://ico.org.uk/.

  11. Terms and Conditions

    Eligibility

    • 1. This promotion is open to all persons aged 18 or over resident in the UK (excluding Northern Ireland and the Channel Islands), other than employees, and their immediate families, of the Promoter and anyone else professionally connected with this promotion
    • 2. The Promoter reserves the right to verify the eligibility of entrants. The Promoter may require such information as it considers reasonably necessary for this purpose and a prize may be withheld until the Promoter is satisfied with the verification.

      How to Enter

    • 3. You will require internet access and an email address to enter the promotion. A purchase is also necessary to enter the promotion.
    • 4. To enter this promotion, prior to the Closing Date (as defined below) you must:
      • a. purchase a promotional 500ml bottle of Erdinger Weissbier (Product) from any UK stockist while stocks last;
      • b. scan the QR code which appears on the neck collar of the Product or visit https://uk.erdinger.de/juergen-klopp-neck-collar-promotion.html (Microsite);
      • c. complete the online form on the Microsite by inserting your full name, email address and the unique reference number (URN) which can be found printed inside the neck collar of the Product; and
      • d. retain your till receipt obtained when purchasing the Product (Receipt) as proof of purchase until 31 December 2023.
    • 5. The instructions provided at the point of entry form part of the Terms and Conditions of this promotion. In the event of a conflict, these Terms and Conditions take precedence.
    • 6. The promotion starts at 00:00 on 2nd October 2023. All entries must be received before the promotion closes at 23:59 on 12th November 2023 (Closing Date). The Promoter accepts no responsibility for entries that are lost, delayed, corrupted or not received by the Closing Date for any reason. Proof of sending shall not be deemed to be proof receipt.
    • 7. Each URN qualifies (and is valid only) for one entry to this promotion, so that no more than one entry can be made for each Product purchased. No more than five entries will be accepted per person for the duration of this promotion. Entries not complying with these Terms and Conditions will be invalid.

      Prize

    • 8. There are 1,501 prizes available to be won, including:
      • a. 1 x 2-night stay at a 4* hotel for the winner and one guest (who must be over the age of 18) in Liverpool City Centre with the chance to attend a Q&A session with Jürgen Klopp on a date in November or December 2023 to be confirmed by the Promoter following the draw date (First Prize). The First Prize includes return travel within the UK by such mode of transport as the Promoter deems in its sole discretion to be suitable (but excluding air travel) and an ”all inclusive” meals and drinks package within the official program; and
      • b. 1,500 x special edition Erdinger pint glasses – 250 available to be won in each week of the promotion (Second Prize).
    • 9. No more than one Second Prize may be won per person.
    • 10. Any further prize details will be confirmed when the winner is contacted. The Promoter reserves the right to substitute an alternative prize of at least equal value if circumstances make this necessary.
    • 11. Each prize is non-transferable and no cash or other alternative will be offered.

      Selection of Winner

      First Prize

    • 12. The winner will be the first entry drawn at random from all eligible entries by a computer process that produces verifiably random results after the Closing Date. The winner will be contacted by the Promoter with 48 hours of the draw taking place using the email address that they used to enter the promotion and will be informed of the date on which the First Prize will take place.
    • 13. To claim the First Prize, the winner must, within 7 days of being contacted:
      • a. confirm to the Promoter that they accept the First Prize; and
      • b. provide to the Promoter a valid Receipt as proof of purchase.
    • 14. Should the winner fail to accept the First Prize within 7 days or be unable to take up the First Prize on the date confirmed, or if the winner is disqualified under the Terms and Conditions of this promotion, then the First Prize will be forfeited and a replacement winner will be drawn at the sole discretion of the Promoter. These Terms and Conditions will apply to any replacement winner and their guest. The Promoter will not be responsible for any inability of the winner to produce a valid Receipt (whether through loss or damage, or for any other reason) or for any inability of the winner to take up the First Prize.
    • 15. The winner and their guest must be aged 18 years or older. The winner must provide to the Promoter on request a copy of their and their guest’s identification to confirm that they are over 18 before the First Prize is awarded. If such identification shows that the winner is under 18 years old, the winner will be disqualified and a replacement winner will be drawn at the Promoter’s sole discretion. If such identification shows that the winner’s guest is under 18 years old, the winner will be asked to nominate a replacement guest. Any failure by the winner to respond to the Promoter's request for guest nomination or proof of identity within a reasonable time may result in the prize being forfeited and a replacement winner being drawn at the discretion of the Promoter.
    • 16. All elements of the First Prize must be taken at the same time and no element of the First Prize may be resold under any circumstances.
    • 17. The winner of the First Prize and their guest shall be responsible for any expenses incurred in the general use and enjoyment of the First Prize outside of the inclusions outlined at paragraph 8(a) above. The Promoter will not be liable to pay any further sums incurred by the winner or their guest for any reason.


    Second Prize

    • 18. 250 Second Prize winners will be drawn on the Monday of each week of the promotion (commencing on 9th October 2023 with the final draw taking place on 13th November 2023) from all valid entries received during the preceding week until all 1,500 Second Prizes have been awarded. A list of draw dates and corresponding entries is provided below:

      • Entries received from: 00:00 on 06.11.23 / To: 23:59 on 12.11.23 / Weekly prize draw date 13th November 2023
    • 19. All entries received between 00:00 on Monday up to 23:59 on Sunday will be entered into the next scheduled draw.
    • 20. The winners will be the first 250 entries drawn at random each week from all valid entries received during the previous week by a computer process that produces verifiably random results. The Promoter will contact the winners by email within 48 hours of each draw taking place using the contact details provided by the winners to enter the promotion.
    • 21. To claim a Second Prize, winners must provide their full UK delivery address to the Promoter within 14 days of being notified that they have won. A Second Prize may be forfeited and a replacement winner drawn at the promoter's sole discretion if:
      • a. the prize is declined, or a winner cannot take up their prize;
      • b. a winner is disqualified under the Terms and Conditions of this promotion;
      • c. a winner fails to confirm their UK delivery address within 14 days of being notified by the Promoter that they have won; or
      • d. delivery of the prize is refused or cannot be completed using reasonable attempts.
    • 22. If you need to amend the contact details you provided to enter the promotion or wish to withdraw your entry from this promotion, please contact the Promoter in writing at gewinnspiel@erdinger.de.
    • 23. To obtain the name and county of the winner, please email gewinnspiel@erdinger.de within three months of the Closing Date. Entrants can object to disclosure or request that disclosure be limited in scope by contacting the Promoter. The Promoter may nevertheless disclose the information to the Advertising Standards Authority if required.


    General

    • 24. The Promoter reserves the right to suspend, cancel or amend the promotion and / or revise these Terms and Conditions at any time without giving prior notice and, by continuing to take part in the promotion subsequent to any revision, entrants shall be deemed to have agreed to the amended terms.
    • 25. The Promoter may in its sole discretion disqualify entries deemed to be non-compliant with these Terms and Conditions or if it has any reason to believe that efforts have been made to distort the competitive process or spirit of the promotion. This includes any individual found to be attempting to circumvent this paragraph by tampering with the operation of the promotion, setting up multiple accounts or using multiple identities. No bulk, consumer group or third-party entries will be accepted. The Promoter’s decision as to any aspect of this promotion is final. No correspondence will be entered in to and there is no right of appeal.
    • 26. The Promoter accepts no responsibility or liability for (a) any URNs, entries or winner notifications which are not received due to the use of incorrect or inaccurate entry information, any faulty or failed electronic data transmissions, or for any other reason; (b) any unauthorised access to, or theft, destruction or alteration of entries at any point in the operation of the promotion; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers used in any aspect of the operation of the promotion; (d) inaccessibility or unavailability of any network or wireless service, the Internet and/or any website; or (e) any injury or damage to any person’s computer(s) or mobile device(s) which may be related to or result from any attempt to participate in the promotion or to download any materials in connection with the promotion.
    • 27. Entry into this promotion is deemed acceptance of these Terms and Conditions.
    • 28. If any provision of these Terms and Conditions is held invalid, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
    • 29. This promotion and all issues arising out of it shall be governed in accordance with English law and is subject to the exclusive jurisdiction of the English courts. Consumers in Scotland may additionally bring an action in their home courts.
